For participants of BDMS 2024:

Academic Annual Meeting

        Bangkok Dusit Medical Services (hereinafter referred to as “BDMS”) under the Bangkok Dusit Medical Services is hosting the BDMS 2024: Academic Annual Meeting – comprising the academic conference, poster and oral presentation, and exhibition of sponsoring to discuss, debate and analyses the important topics on safety and sustainability of the world’s protein supply system to help guide the food industry and regulators to make evidence-based decisions on how our future protein supplies should be produced to best protect planetary and human health. Individuals interested to attend the conference must register as participants accordingly. It is imperative that BDMS collect, use and/or disclose your personal information as a participant of such event.

The personal data protection and compliance with the Personal Data Protection Act (PDPA) and BDMS’s top priority to assure that your personal information is used in accordance with intended purposes and the law, this “Privacy Notice” is created for participants who registers to attend the conference to notify you as the owner of personal data of the purposes and details of personal data collection, use and/or disclosure, as well as your legal rights.

1. Definition

“BDMS” means the Bangkok Dusit Medical Services

“Agency” means the Bangkok Dusit Medical Services

“Personal Data" means any information relating to a person, which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased persons in particular.

Other information that is not considered personal data because the individual who owns it cannot be identified; however, if the BDMS can combine or link this other non-personal information with other personal information in order to directly or indirectly identify the Data Subject, this other information shall be deemed one of the categories of this privacy notice.

"Data Subject" means the person who owns Personal Data.

"Data Processing" means the collection, use and disclosure of Personal Data.

The BDMS do not intend to process Personal Data of minors, incompetent persons, or quasi-incompetent persons unless the BDMS has obtained the consent of a parent, curator, or guardian, or unless other legal bases are encountered. Therefore, if you are a minor, an incompetent person, or a quasi-incompetent person, please notify your parent, curator, or guardian who has the authority to act on your behalf of the details in this announcement and obtain consent from the parent, curator, or guardian who has the authority to act on your behalf to ensure that the BDMS can process your Personal Data.

If the BDMS discovers that it has processed Personal Data of minors, incompetent persons, or quasi-incompetent persons without the consent of the parent, guardian, or guardian and cannot rely on other legal bases, the Personal Data will be deleted or destroyed.

3. Sources of Personal Data

(1)  The BDMS has directly received Personal Data from a Data Subject through the registration system.

(2) The BDMS has received Personal Data of a Data Subject from a third party, whereby the BDMS believes in good faith that such third party is entitled to collect and disclose the Data Subject’s Personal Data to the BDMS.

(3) If you bring or inform Personal Data to the BDMS without authority or reasonable cause under the law, you are responsible for compliance with the Personal Data Protection Act 2019 and the relevant regulations. The BDMS is not involved in the control and security. Since the BIOEC is unaware of the source of the person's personal information that you have informed or delivered. Your information, however, will be safeguarded in accordance with the BDMS standards.

However, if you refuse to provide the BDMS with necessary information, it may result in the BDMS not being able to provide services or carry out tasks to achieve the purposes for Data Subject in whole or in part.

4. Purposes of processing personal data

The BDMS processes your Personal Data for the purposes acceptable by the law. This includes processing Personal Data in order to perform tasks as your contract counterpart, to perform legal duties for legitimate interests and to process your consent with the purposes of processing personal data as follows.

(1) To prove and verify your identity and register you to the event and activities.

(2) To manage and facilitate your participation, such as answering questions, coordinating, notifying information, and sending event documents.

(3) To analyze, research and/or prepare statistical data for future improvement of the BDMS’s event organization and internal services.

(4) To produce reports and promote the BDMS by providing still and moving images of the event and participants. This may include sound and/or images of you attending the event. If you do not wish to be photographed or recorded, you can notify the BDMS. For those who did not inform, and you find your sound, still images and/or movies, you can ask the BDMS to suspend the use and/or publication on the part that has you in it.

(5) To support marketing campaign and provide news and information related to the services of the BDMS, such as sending event invitations, submitting service proposals, events or meetings organized by the BDMS.

(6) To perform other tasks of the BDMS such as administration, risk management, internal audit, maintaining legitimate interests, database establishment, satisfaction survey, legal process, complaint management or handling of incidents against the law or suspected events, information technology operations, communication system management, and IT risks and cyber threats prevention.

(7) To comply with an order of a legal authority and/or comply with the laws, such as complying with a court order, government order, authority to supervise the BDMS, government officials authorized by the Personal Data Protection Act, Computer-Related Crime Act and other laws that the BDMS must comply with both in Thailand and abroad. These also include announcements and regulations issued according to such laws both already come into force or to be amended or to be held in the future.

(8) To prevent or suppress any danger to life, body, or health of a person.

(9) To prepare historical documents or archives for the public interest or purposes relating to research studies or statistics that do not rely on your legal consent.

(10) To carry out missions for the public interest of the BDMS or performing duties in exercising state powers that have been given to the BDMS.

Provided that the BDMS requires to process your Personal Data for performing, follow your signed contract with the BDMS and/or the performance of its legal obligations, and you do not provide such necessary Personal Data to the office upon request, the BDMS may not be able to approve or deliver some or all of the services to you which may affect the performance of duties according to the laws of the BDMS.

5. Disclosure of Personal Data

The BDMS may disclose your Personal Data to other people or organizations both inside and outside the BDMS under the consent of the owner of the information or under the Personal Data Protection Act 2019. The BDMS may disclose your Personal Data to the following third-party individuals or entities.

(1) Sponsor

(2) Agents, Contractors/Subcontractors, and/or service providers for the BDMS's operations, such as an organizer company, an activities event contractor, a media production contractor, and a public relations contractor.

The BDMS may disclose or deliver still images and audio-visual recordings of the event which may contain your images and sound through the public relations channels of the BDMS to report and publicize the work of the BDMS. On condition that you do not wish to be photographed or recorded, you can notify the staff of the organizer. For those who did not inform, in case you find your sound, still images and/or movies in the public space, you can ask the BDMS to suspend the use and/or publication on your part.

6. Use of Cookies and/or similar technologies

The BDMS may collect and use cookies and/or other similar technologies when you access the BDMS’s website and/or application to process transaction or use the BDMS’s service via digital and internet network. Such action will help the BDMS remember your usage and preferences including analyzing your interests to improve the performance of the website and/or application of the BDMS, to respond to the needs and usage so that you can get good experience from using the website and/or the application of the BDMS.

7. Period of Storage of Personal Data

The BDMS will keep your Personal Data for 10 years after the completion of the BDMS 2024: Academic Annual Meeting. After the lapse of such period, the BDMS will destroy, delete, or make unidentifiable of your Personal Data. However, in the event of a dispute over the exercise of rights or lawsuits related to your Personal Data, the BDMS reserves the right to retain such data until such time as the dispute has been resolved, or a final order or judgement on the dispute has been handed down.

8. Security of Personal Data

The BDMS provides appropriate security measures to prevent any unauthorized or undue access to, use, change, rectification or disclosure of the Personal Data.  Moreover, the BDMS has set out its internal practice for authorization of access to or use of the Data Subject’s Personal Data in order to keep such data confidential and safe.  The BDMS shall review such measures from time to time as appropriate.

9. Rights of the Data Subject

You are entitled to the following rights according to the Personal Data Protection Act:

(1) Right to withdraw consent - You have the right to withdraw your consent at any time during the period in which the BDMS keeps your Personal Data, unless there are restrictions on that right by law or there is a contract that benefits you. The withdrawal of your consent will not affect the collection, use, and/or disclosure of your Personal Data that was done prior to the withdrawal of consent.  However, your consent withdrawal may result in the BDMS's inability to perform duties assigned in the contract or provide services to you. Or it may result in any other related transactions or activities being suspended or temporarily stopped. It may affect your knowing about various services or not receiving information, useful advice, etc., for your benefit. Therefore, you should study and inquire about the impact before withdrawing your consent.

(2)  Right of access - You have the right to access your Personal Data kept under the BDMS’s responsibility and request the BDMS to make a copy of such Personal Data for you and request the BDMS to disclose how your Personal Data was collected.

(3) Right to data portability: You have the right to request your Personal Data in case the BDMS has made such data available in a format that can be read or used by tools or devices that work automatically and can use or disclose personal information by automated means, including having the right to request the BDMS to send or transfer your personal data in such form to another data controller when it can be done by automatic means, the right to obtain Personal Data that the BDMS sends or transfers in such form directly to another data controller unless it can't be done for technical reasons. However, your above-mentioned Personal Data must be personal data for which you have given consent to the BDMS's processing, or it is Personal Data that the BDMS needs to process so that you can use the services of the BDMS according to your wishes, or so that the BDMS can process your request to use the service of the BDMS or other Personal Data as required by the authorized person under the law.

(4) Right to object - You have the right to object to the processing of your Personal Data at any time in case the processing of your personal data is carried out for necessary operations under the legitimate interests of the BDMS, or of another person, a juristic person, or to carry out missions for the public interest. If you file an objection, the BDMS will continue to process your Personal Data only where it can demonstrate legal grounds that it is more important or to establish legal claims compliance with or exercise of legal claims. You may also have the right to object to the processing of your Personal Data for direct marketing purposes, or for scientific research purposes, history, or statistics as well.

(5) Right to erasure – You have the right to request the BDMS to delete, destroy or anonymize your Personal Data in the event that you believe that your Personal Data is processed illegally, or that the BDMS does not need to keep such Personal Data for the purpose announced on this Privacy Notice, or that you have exercised the right to withdraw or the right to object as mentioned above.

(6) Right to restrict – You have the right to request the BDMS to restrict the use of your Personal Data under certain circumstances when there is a pending examination process of the BDMS in accordance with your request to rectify your Personal Data or object to the collection, use and/or disclosure of your Personal Data, or your request to restrict the use of your Personal Data instead of the deletion or destruction of your Personal Data.

(7) Right to rectification - You have the right to rectify your Personal Data so that it is accurate, up to date, complete and does not cause any misunderstandings.

(8) Right to lodge a complaint – You have the right to file a complaint with the relevant authority if you believe that the processing of your Personal Data is in violation of the laws or does not comply with applicable laws.
